Our website grants you two possible types of license to use the website templates and other products (the “products”) sold through our website by independent content providers in accordance with these Terms and Conditions (the “license”) issued by our company, as follows:
ONE TIME USAGE LICENSE
You may be granted a One Time Usage License in case of purchasing a website template at a Non-Unique Price. It enables you to use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template again if you to use the same design in connection with another or other projects;
BUYOUT PURCHASE LICENSE
You may be granted a Buyout Purchase License in case of purchasing a website template at a Buyout Purchase Price. This type of license guarantees that you are the last person to buy this template. After the buyout purchase occurs, the template is permanently removed from the Horizons Live LLC sales directory and is never available to other customers again. You can not redistribute or resell templates after Buyout Purchase Price.
IMAGERY, CLIPARTS AND FONTS
All imagery, clipart, fonts and video footages used in our products are royalty-free and are the integral part of our products. One Time Usage License gives you the right to use images, clipart, fonts and video footages only as a part of the website you build using your template. You can use imagery, clipart, fonts and video footages to develop one project only. Any kind of separate usage or distribution is strictly prohibited. All images and illustrations used in templates come in a single layer, as is.
You are authorized to make necessary modification(s) to our products to fit your purposes in accordance with the type of license you acquire.
If you have not received the Buyout License, you shall not place any of our products, modified or unmodified, on a CD, website or any other medium. You also shall not offer them for redistribution or resale of any kind without prior written consent from our company.
You shall not sub-license, assign, or transfer the any mentioned above to any entity without prior written consent from our company.
Except where otherwise expressly provided by horizonslive.com, all comments, feedback, or information submitted to horizonslive.com through or in association with horizonslive.com (collectively, “User Content”) will be considered non-confidential and horizonslive.com property. By submitting such User Content to horizonslive.com, you agree that you assign to horizonslive.com, without charge, all worldwide rights, title and interest, including copyrights and other intellectual property rights, in and to the User Content. Horizonslive.com will be free to use such User Content in any manner or media whatsoever, on an unrestricted basis and without any compensation or royalties to you.
You also represent and warrant that you own or otherwise control all of the rights to the User Content that you post; that the User Content is accurate; and that use of the User Content you supply does not violate this policy and will not cause injury to any person or entity. Horizonslive.com has the right but not the obligation to monitor and edit or remove User Content. Horizonslive.com takes no responsibility and assumes no liability for any User Content posted by you or any third party.
Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.
Since horizonslive.com is offering non-tangible irrevocable products we do not issue refunds once the order is performed and the product is delivered, which you are responsible for understanding upon purchasing. Please make sure that you have carefully read all relevant documentation and tried out the demo.
However, we are aware that some circumstances can occur under which we are to review a refund request. With regard to the specific character of the product we provide, there are reasons, upon which a REFUND REQUEST can be applied:
Non-delivery of the product: in case some mailing issues occur and an e-mail with a download link is not delivered to you, please contact us for assistance. Claims for non-delivery must be submitted to our Technical Support Team in writing within 7 days from the order placing date.
Download and unzipping issues: in case you faced with the problems while downloading the product or its unzipping, you have to contact our Technical Support Team without any delay. If you do not contact us during this period, you agree that we may construe silence as a successful download of the product without further right of redress or refund for a “download issue” reason.
Major bugs and defects: when you stably encounter an error which is preventing you from using our product properly, and if we are not able to correct the error within an acceptable period of time or are unable to suggest a temporary solution, the refund will be issued to the customer in full without any compensations. Such issues must be submitted to our Technical Support Team’s approval.
Product not-as-described: such issues should be reported to our Technical Support Department within 7 days from the date of the purchase. Clear evidence must be provided proving that the purchased product is not as it is described on the website.
Please make sure you tried Horizons Live Templates Live Demo before you place your order to verify that the product you are purchasing satisfies your needs. Complaints based on the absence of features which we never claimed to provide and which are not listed in the feature list for our product are not honored.
Please note, that we do not guarantee to save the content you create in the demo version of the template because of the possible issues that may occur on the server.
Please note, that we do not assume the responsibility and therefore reserve the right to refuse a refund request based on incompatibility of our products with some third-party software.
We will send you an e-mail to notify whether you are eligible for a refund based on the proof of purchase you provided and product package you returned to us (if any). You must also destroy all copies of the software you may have made or stored in any place, as well as remove the software from any computers owned or controlled by you.
If your request for a refund is confirmed, the money will be processed to your credit card account within 2 to 7 business days following confirmation of eligibility.
